Terms of our Engagement and Power of attorney

Our mission:

We will work tirelessly to get you compensated and will not rest until you get every Dollar/Shekel/GBP, etc. that is owed to you! If we do not collect for you, no fees is owed to us or our attorneys.

The process:

Immediately upon receiving all the facts from you, we will commence your efforts on your behalf. In our discretion, we will either submit a claim letter or prepare a lawsuit depending on which airline is involved. If the lawsuit needs to be commenced in Israel, depending on the amount of the claim, the litigation is either filed in small claims court or for more sizable matters we hand the matter over to our Israeli lawyers. Either way, if we do not collect for you, no fees is owed to us or our attorneys.

Your part:

  1. Inform us if you are contacted by the airlines and provide us with the name and phone number the person who contacted you,
  2. Inform us immediately if you (and/or fellow travelers) receive payment from the airline,
  3. Pay the Court’s filing fee of the lawsuit – in advance of filing (1% of the face value of the lawsuit with a minimum of 50 NIS),
  4. Provide any all assistance to expedite the process,
  5. Appear in court if the need arises (Israeli residents only)

Our fee schedule:

  1. Recovery of funds while in the claim stage (prior to filing a lawsuit)

Our fee is:

  • 20% of the amount recovered for reimbursement of any of your out-of-pocket expenses
  • 33.3% of the amount of the value recovered* (other than out-of-pocket expenses)

For clarification, our fee attaches to the recovery of funds from the date of the submission of the claim letter.

  1. Recovery of funds after commencing litigation (either by settlement – whether in court or prior to the hearing or by court decision).

Our fee is:

  • 33.3% of the amount recovered for reimbursement of any of your out-of-pocket expenses
  • 50% of the amount of the value recovered (other than out-of-pocket expenses)

For clarification, the fee listed below takes effect upon filing of the lawsuit.

For further clarification, the fee schedules are mutually exclusive and not cumulative (it is either 1 or 2 and not both)

A settlement (whether in or out of court) or verdict, must be sufficiently particularized so that it is clear which part of the recovered funds is for compensation and which part of the funds agreed to be paid is for reimbursement of expenses. Without said particularization, it will be deemed that the settlement funds is for compensation up to the amount demanded in the claim or lawsuit for compensation and the remainder will be deemed for reimbursement of expenses.

Value recovered is defined as:

  1. Cash/check
  2. Replacement ticket(s) **
  3. Voucher – (stated value listed or see below if no stated value) **
  4. Additional compensation as mandated by law (exemplary damages)
  5. Interest
  6. Other damages

**For Replacement tickets/vouchers with no stated value:

  • For flight over 6 hrs valued at $1200
  • For flight under 6 hrs valued at $600
  • We never decide whether you accept cash or a voucher, that decision is strictly yours.

We do not promise any specific results and our fee is not contingent upon a ‘satisfactory’ recovery. If we collect for you, depending upon the ‘stage of the game’, the fee is as listed above

JustNotFare’s fee must be paid within 3 business days of receipt of the funds from the airline. Failure to do so will result in a penalty of 50 NIS (or the equivalent thereof) per day until the fee is paid in full.

JustNotFare’s fee is is due once a claim letter is submitted or litigation is submitted (whichever is undertaken first) , including but not limited to the following situations:

  • If you submitted a claim to the airline prior to retaining our services and the airline contacts you directly in response (note: airlines often make reduced settlement offers, so we strongly recommend consulting with us before responding).
  • If the airline requests that you negotiate with them directly (we will, of course, assist you in preparing for such negotiations).
  • If you, or anyone acting on your behalf, accepts a settlement offer directly from the airline, whether or not we were involved, or if compensation is paid directly to you.
  • If you are dissatisfied with a court ruling or a court-approved settlement.

Failure to appear in court may result in dismissal of your claim. In the event that you fail to appear in court for any reason whatsoever, you will be liable to pay JustNotFare’s fee of 1,000 NIS (or the equivalent in another currency) as compensation for the time and work invested in handling your claim.

NAMES OF ALL PASSENGERS


Please provide concise but detailed summary re your flight fiasco which includes but is not limited to the following information:
• Date and time of flight
• What happened with that flight
If delayed - when did the flight finally take off
If cancelled – how many days before the flight did you receive notice of the cancellation did the airline provide you with a replacement flight (include details, e-ticket etc.)
• Were out of pocket expenses incurred if so how much and why
• All other relevant information.
